ARPA v Ontario (2017)

Ontario Superior Court of Justice

Summary:

In 2010, the Ontario legislature amended the Freedom of Information and Access to Information Act to take away the public’s right to access government data about abortion. ARPA successfully challenged the law on the grounds that it violated freedom of expression. The Court struck down the provision that excluded abortion data from the right of access to government information. This was the first case Canadian history to successfully use freedom of expression to expand access to information in the possession of the executive branch of government.
